Caerphilly Homes Successions

Under the Renting Homes (Wales) Act 2016, a succession refers to the legal process by which a person takes over a Secure Occupation Contract after the original tenant dies.  A person (or persons) living with a tenant when they died may be entitled to become the tenant.

This allows certain people who have been living in the property as their main home to continue living there and take over all the rights and obligations of the original Secure Occupation Contract.

Who may be eligible to succeed.

  • A spouse, civil partner or someone living with the deceased as if they were, as long as they were living together at the time of the death. 
  • A family member, this includes parents, grandparents, children, grandchild, brother, sister, uncle, aunt, nephew, and niece. It also includes relationships where one parent is shared and step-relationships.  A family member must have lived with the deceased and or lived at the dwelling for 12 months prior to the death. 
  • A carer may be eligible to succeed if they were the carer (for either the tenant or a member of their family who lived with them) at any time in the 12 months before the death.  Also, if they lived at the property as their only home for 12 months prior to the death and had no other home they were entitled to occupy.  Care does not count if it is given because of a contract or employment.
