Caerphilly Homes Transfer

Under the Renting Homes (Wales) Act 2016, a transfer of a Secure Occupation Contract involves the legal process of transferring a contract from one person to another.  A transfer takes place where a contract holder passes their rights and obligations in the contract (including the rights to live there) to a new contract holder.

The transfer process requires a written request from the contract holder (tenant), it involves formal documentation and approval from Caerphilly Homes as their Community Landlord. 

A tenant of Caerphilly Homes can request to transfer their Secure Occupation Contract to someone who would be a potential successor or to a tenant of a Community Landlord.  A Community Landlord is either a local authority or housing association.

This can happen in several situations.

  • The tenant may request to transfer their entire interest in the property to another person who would be qualified to succeed.  If approved the new tenant takes over all the rights and obligations of the original Secure Occupation Contract. 
  • The tenant may request to transfer their entire interest in the property to a contract holder of either Caerphilly Homes or another Community Landlord.  If approved the new tenant takes over all the rights and obligations of the original Secure Occupation Contract. 
  • The tenant may request to swap their Secure Occupation Contract with a tenant of a community landlord.  If approved, they would effectively swap homes and the new tenant takes over the rights and obligations of the original Secure Occupation Contract of the previous tenant.
